Terms of Service

This document is a pre-launch draft. It will be reviewed by a qualified legal professional before X4 Digital accepts paying customers. Placeholder company details are used throughout.

1. Service Description

X4 Digital ("we", "us", "our") provides an AI-powered website design and hosting service. Our platform uses artificial intelligence to generate custom websites based on your input, delivered as HTML, CSS, and JavaScript files hosted on Cloudflare Pages.

The service is provided "as-is." We make no guarantees of uptime, availability, or fitness for a specific purpose.

2. Content Ownership

You own the content you provide (text, images, documents). X4 Digital retains no ownership of your content.

Generated code: you receive a perpetual, non-exclusive license to use the generated website code. Ownership of AI-generated code follows applicable law in your jurisdiction.

You may download your site files (HTML/CSS/JS/images) at any time via your dashboard and self-host them.

3. Hosting and Availability

Hosting is included as part of your subscription.
We do not guarantee any specific uptime percentage or SLA.
If you cancel, Free tier hosting continues with limited features. Your site is never deleted without your explicit request.
We reserve the right to discontinue the service with 30 days written notice.
You can export and self-host your site at any time.

4. Billing

A one-time activation fee of EUR 1 (or USD 1 equivalent) is charged at signup. This fee is not credited toward any subscription.
The Starter plan (EUR 9/month) begins billing 30 days after activation.
Subscriptions auto-renew monthly until cancelled.
Cancel during the first 30 days (before the first EUR 9 charge): immediate downgrade to Free tier, no subscription charge.
Cancel after the first subscription charge: effective at the end of the current billing period.
No refunds for partial months, except as required by the EU/UK 14-day cooling-off period (see Refund Policy).
Downgrading to Free does not delete your site. Content is never held hostage.

Failed Payments

If a subscription charge fails, we retry up to 3 times over 7 days. During this period, your account remains on its current tier. After all retries are exhausted, your account is automatically downgraded to Free. You will be notified at each step and can update your payment method from the dashboard.

Price Changes

Price changes for existing subscribers require 30 days advance notice. New pricing applies at the next billing period after the notice period. You may cancel before the new price takes effect.

5. Acceptable Use

You agree not to use X4 Digital for:

Illegal content, malware, phishing, or hate speech
Content that violates applicable law
Automated or bot abuse of the site builder

We may suspend or terminate accounts that violate this policy.

6. Limitation of Liability

X4 Digital is not liable for: business losses, lost revenue, lost customers, or any indirect, consequential, incidental, or special damages arising from use of the service, including downtime, bugs, or design errors.

Our maximum liability is capped at the fees you paid in the prior 3 months, or EUR 50, whichever is greater.

AI-generated content may contain errors. You are responsible for reviewing and approving your site content before publishing.

X4 Digital is not responsible for third-party integrations (Stripe, Google, Cloudflare, etc.).

7. EU/UK Consumer Rights

If you are a consumer in the EU or UK, you have a 14-day right of withdrawal from the date of purchase under the EU Consumer Rights Directive and UK Consumer Contracts Regulations.

To exercise this right: use the one-click downgrade button in your dashboard, or email support@x4digital.co. A full refund will be processed within 14 days of your withdrawal request.

8. Governing Law

These terms are governed by the laws of [Jurisdiction — to be determined by legal review]. Disputes will be resolved in the competent courts of [Jurisdiction].

9. Changes to Terms

We may update these terms. Material changes will be communicated via email or dashboard notification at least 30 days before they take effect. Continued use after changes constitutes acceptance.
